HOW TO PARTICIPATE: If you do not already have a SHiFT account, you must establish one in order to participate in this Program. Establishing an account is free but you will need internet access and an email account. All SHiFT terms apply, available at https://shift.gearboxsoftware.com/legal. At the time you establish an account, you will be asked if you wish to opt-in to this Program. If you already have a SHiFT account, visit https://borderlands.com/en-US/vip/ to opt-in to the Program.
The ways in which you can earn points, virtual rewards and in-game items as part of this Program (“Eligible Activities”) will be set forth on https://borderlands.com/en-US/vip/ (“Site”). The points, the virtual rewards and in-game items you can earn via the Eligible Activities will also be set forth on the Site. Note: Currently T2 is only able to deliver in-game rewards to Vault Hunters on PlayStation 4, Xbox One, and Epic. Note: Not all Eligible Activities may be available to all participants since some Eligible Activities may be location-based.
If an Eligible Activity involves a specific social media platform, you must have an account on that social media platform in order to complete that Eligible Activity. Establishing an account is free. In some instances, your account or post must be set to “public” in order for that Eligible Activity action to be recorded by T2. You can return the applicable account to “private” any time after you receive the points, in-game item or reward associated with that Eligible Activity.
Points, in-game items and virtual rewards have no cash value and cannot be transferred. Eligible Activity completions generated by script, macro or other automated means with the intent to subvert or impair the integrity of this Program will be disqualified and any associated points, in-game item or reward will not be provided. T2 reserves the right to add, modify and/or discontinue an Eligible Activity and/or modify the points, in-game item or reward item(s) associated with any Eligible Activity at any time and for any reason. T2’s decisions with respect to the number of points, in-game items and virtual rewards that can be earned and awarded in the Program are final and binding.
POINT CONDITION AND RESTRICTIONS: Points will be valid for the duration of the Program and for at least 1 month after the Program has ended. Points will be added to your account within 48 hours of Eligible Activity completion. You can view your point balance by returning to the Profile page on the Site. In addition, you understand:
• Points have no "real world" or cash value and can only be used in connection with this Program.
• Points have no purpose or use except in exchange for benefits or privileges (if any) offered as part of this Program.
• Point redemption offers may be time-limited or available only in limited quantities.
• Points cannot be redeemed by, or sold or otherwise transferred to, any other individual participating in this Program.
• Upon termination of your registration for any reason, all unredeemed points will be void.
• Due to bugs or other errors or problems, T2’s ability to accurately credit points to your account based on your activities on a social networking site may be restricted by the terms, conditions or functions of such site.
• Points are not valid unless earned in strict compliance with the requirements as established and intended in these Terms and on the Site, and you shall not attempt to earn points by any means (including without limitation, by using any script, bot or other automated means) that only simulates compliance with the applicable requirements.
• In the absence of substantiation provided by participant, T2's good faith determination of the amount of points available to you hereunder shall be final and binding.
Persons found tampering with or abusing any aspect of this Program, who are acting in a disruptive or unsportsmanlike manner or who are otherwise not in compliance with these terms as solely determined by T2 will be disqualified and all associated points, virtual rewards and/or in-game items may be revoked.
REWARD TERMS: All available virtual rewards and in-game items for which you can redeem your points and/or receive by completing an Eligible Activity will be set forth on the Site. Any additional terms and conditions that may apply to the use of the virtual reward or in-game item will also be set forth on the Site. In addition, T2 reserves the right to offer “exclusive” reward opportunities to you or other participants based on the your current balance of "redeemable" points (that is, points that have not previously been redeemed) or "lifetime" points (that is, all prior points accumulated by you, whether previously redeemed or not). All reward item details are at T2’s reasonable discretion. You cannot transfer, substitute or redeem rewards for cash. T2 reserves the right to substitute a reward item of comparable or greater value if required for reasons outside of its control. You are responsible for all federal, provincial, state and local taxes as well as any other costs or expenses associated with a reward item not specified in these Terms or on the Site as being provided, if any. If there is a limitation on how many times you can redeem for any single Reward, it will be set forth on the Site. For Australian residents, nothing in these terms restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
RELEASE OF LIABILITY FOR ALL INDIVIDUALS (EXCEPT RESIDENTS OF GERMANY): By agreeing to these Terms, except where prohibited by law or otherwise expressed stated herein, you agree (i) to release, discharge, indemnify and hold harmless T2, Twitter, Facebook, Instagram, Twitch, and their respective parents, affiliates, subsidiaries and advertising and promotion agencies and any of their respective officers, directors, employees, agents or representatives (collectively, “Released Parties”) from any liability or damages which may arise out of participation in the Program or out of the acceptance, use, misuse or possession of any reward items or products attained through this Program, except in connection with residents of France and the United Kingdom, when such damage has been caused by T2’s breach of its legal or contractual obligations under these Terms. Released Parties are not responsible for damage to participants' or to any other person's computer related to or resulting from participating in this Program or downloading materials from or use of the Site when the damage has not been caused by T2 breach of its legal or contractual obligations under these Terms, or when the damage results from a force majeure event or the action of a third party which cannot be foreseen and avoided.
With the exception of residents of France and the United Kingdom, Released Parties are not responsible for late, lost, incomplete, delayed, inaccurate, garbled, undelivered, misdirected points, virtual rewards, in-game items or Eligible Activities or other errors or problems of any kind relating to or in connection with the Program, whether printing, typographical, technical, computer, network. human, mechanical, electronic or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Program, the tracking of Eligible Activities, the announcement of the in-game items or virtual rewards or in any Program-related materials.
For Residents of France and United Kingdom: Released Parties are not responsible for lost points, virtual rewards, in-game items or Eligible Activities or other errors or problems of any kind relating to or in connection with the Program, whether technical, computer, network, mechanical, electronic or otherwise, which do not result from T2 breach of its legal or contractual obligations under these Terms, or which result from a force majeure event or the action of a third party which cannot be foreseen and avoided.
TERMINATION/SUSPENSION: T2 reserves the right to modify, suspend or cancel the Program at any time. T2 will provide sufficient notice the participant of any material changes before these changes take effect. Your continued participation in this Program denotes your acceptance to these Terms. You should review these Terms periodically to ensure familiarity with the most current version. You will always be able to tell when the version was last updated by checking the "Last Revised" date at the top of these Terms. All questions or disputes regarding the Program, including without limitation, those involving eligibility, participation, fraud and abuse will be resolved by T2.
CHOICE OF LAW: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the participant and T2 in connection with the Program, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York. Notwithstanding the preceding sentence, the governing law for participants within the European Union shall be the law of that participant’s country of residence.
